Section 360R of the Telecommunications Act 1997 (the Act) requires a statutory infrastructure provider (SIP) to give notice if it can no longer meet its SIP obligations to connect and supply services in a service area.
The notice should include details (if known) of the carrier or carriage service provider (CSP) that is willing to take responsibility for the service area.
Who do you need to notify
- the ACMA
- the Secretary of the Department of Infrastructure, Transport, Regional Development, Communications and the Arts (the Department)
- your customers.
When do you need to notify
If there is an alternative SIP
If a carrier or CSP is willing to take responsibility for the service area, give the notice:
- at least 90 days before you can no longer fulfil your SIP obligations, or
- in any other case, no later than 10 business days after the new carrier or CSP becomes the SIP for that area.
If there is not an alternative SIP
If a carrier or CSP has not been identified for the service area, you must give notice earlier:
- at least 12 months before you can no longer fulfil your SIP obligations, or
- in any other case, no later than 10 business days after you can no longer fulfil your obligations.

Complete the electronic exit notice below and click ‘submit’. A copy of the exit notice will be sent to your nominated email address. This can be used to submit to the Department.

Notifying your customers
You are required to notify affected customers that you will be ceasing to operate as a SIP. You must do this by providing each customer in the relevant service area with the following information:
- likely date you will stop providing services for the service area
- name and address of the relevant service area (as referenced in the declaration given to the ACMA)
- name and contact details for the carrier/CSP that is willing to become the SIP for the service area (if known)
- if your customers are CSPs, you must advise them of their obligation to notify their end-user customers if there is likely to be a change or disruption to their services.
