Proposal to remake the Broadcasting Services (Remote Indigenous Communities) Determination 2011 - consultation 01/2022

The Broadcasting Services (Remote Indigenous Communities) Determination 2011 is due to sunset on 1 April 2022.

The ACMA’s preliminary view is that the Remote Indigenous Communities Determination should be remade with:

  • minor amendments to the list of communities included
  • minor and technical changes.

The consultation paper invites comment on our preliminary view via targeted questions.

We received 4 submissions to this consultation, which are available at the bottom of this page. On 24 March 2022, following consideration of submissions, the ACMA made the Broadcasting Services (Remote Indigenous Communities) Determination 2022. The new instrument has been amended to:

  • include 14 new communities
  • remove the community of Oombulgurri, which is no longer inhabited, and one instance of Pukatja (Ernabella) that was duplicated
  • update or correct the entries for 9 communities.

Previous consultation: The issue

Under Section 8B of the Broadcasting Service Act 1992 (the BSA), the ACMA can classify an Indigenous community as a ‘remote Indigenous community’.

There are rules in the BSA that set out what community broadcasting licensees must do when their services are targeted to remote Indigenous communities.
