Annual statement of compliance for telcos

Carrier service providers must meet the Telecommunications Consumer Protections Code (TCP Code). To show you comply, you need to submit a compliance statement each year.

Who has to submit a compliance statement

You must submit your statement to Communications Compliance if you:

  • supply goods or services that another company uses to provide a listed carriage service
  • have residential and/or small business consumers

When to submit your statement

The deadline depends on how many services you have in operation. You can usually submit the statement online up to 3 months before the deadline.

Providers that operate fewer than 3000 services have a deadline of 1 April. You can ask Communications Compliance to defer your deadline until 1 September. You must ask them before the 1 April deadline. 

Providers that operate 3000 services or more have a deadline of 1 September.

How to submit your statement

Step 1: register with the Communications Alliance

You must register with Communications Alliance, even if you’re a member of the Communications Alliance.

Registration is free, easy and online. The information you need to provide includes:

  • the legal name of your business
  • the Australian Business Number or Australian Company Number
  • all relevant trading names
  • your business website address
  • a contact person and details on how to contact them

New providers must register within 1 month of the date you sign up your first customer.

Existing providers whose registration details change must update their registration within 1 month.

Step 2: complete the online statement

After you register, sign in to submit your statement to Communications Compliance.

What happens if you miss the deadline

If you miss the deadline, you are breaking the TCP Code. We may give you a formal warning or direct you to comply.
