On 25 July 2024, after considering the submissions, we made the Radiocommunications (Exemption) Determination 2024. This replaces the Radiocommunications (Exemption) Determination 2021 on 28 August 2024.
We received 2 submissions to the consultation. Both submitters supported the remake and minor changes we proposed. You can access the submissions at the bottom of this page.
Previous consultation: The issue
The Radiocommunications (Exemption) Determination 2021 is due to expire by self-repeal on 28 August 2024. This instrument is a key component of the innovation and industry development exemption framework. This allows for limited and controlled access to equipment banned under the Radiocommunications Act 1992. The framework is designed to promote research and development, manufacturing, market development and innovation opportunities involving banned equipment for Australia’s defence, technology, and radiocommunications sectors.
Our view is that the Radiocommunications (Exemption) Determination 2021 is operating effectively and efficiently.
We plan to remake the instrument before its self-repeal date with minor changes to:
- capture ‘screened room’ operation in a definition for ‘shielded enclosure’
- allow for a 5-year self-repeal date
- put arrangements in place for named person exemptions.
