Previous consultation: The issue

Under Part 4, Chapter 3 of the Legislation Act 2003, most legislative instruments ‘sunset’. They are automatically repealed on either 1 April or 1 October, depending on which date comes first 10 years after they are registered.

Legislative instruments linked to the technical framework for several spectrum licence bands are due to sunset on 1 April 2023. The relevant licence bands are:

  • 700 MHz
  • 1800 MHz
  • 2.5 GHz
  • 2.5 GHz mid-band gap.

We believe these instruments form a necessary and useful part of the regulatory framework. We propose to remake them with some changes.

You can see the details of the changes proposed and reasoning are in the consultation paper. Copies of the new draft instruments are also available above.
