The ACMA has today published an outcomes report in response to our recent TV prominence consultation. This report summarises stakeholder submissions and updates the ACMA’s preliminary views on a range of matters, including the exercise of our discretionary powers.
The TV prominence scheme is designed to make it easier for Australians to find and access free-to-air TV services and apps on smart TVs and similar devices. It will apply to devices manufactured and supplied from 10 January 2026, and will be administered by the ACMA.
The outcomes report provides further guidance to industry on the types of devices that are likely to be caught under the scheme, and the factors that may inform these decisions. It also updates our views on primary user interface issues that are fundamental to achieving the policy objectives of the framework.
The report provides information on the ACMA’s key areas of focus for 2025 in the lead up to the commencement of the scheme. This includes making standalone guidelines regarding the scope of regulated television devices, further engagement with stakeholders, considering our research and data needs, and developing a compliance and enforcement strategy. We are not intending to make any legislative instruments at this time.
The ACMA’s outcomes report follows the registration of the minimum prominence requirements established by government in the Broadcasting Services (Minimum Prominence Requirements) Regulations 2024.
