Why was I sent a compliance alert?
We’ve sent you an alert because someone has made a complaint that your business is not following Australia’s telemarketing laws.
The alert is a chance for your business to review its telemarketing compliance.
What should I do next?
You can get in touch with us if your business has improved its processes to follow the telemarketing laws, or if you think there’s been a mistake. Find out more about the laws and how to comply.
You can also take some simple steps to help you follow the rules:
- Wash your numbers
‘Washing’ is when you check your calling lists against the Do Not Call Register. This is the only way to make sure you don’t call numbers on the Do Not Call Register (unless you have permission or are exempt). The washing process is fast and easy. Information on how to create a washing account is on the Do Not Call website.
- Check your consent to make calls
People can agree to receive your telemarketing calls directly, or sometimes, you may be able to infer consent. You can’t infer consent just because a number is published online or somewhere else. Find out more about consent.
- Review your scripts and call conduct
Anyone making telemarketing calls must:
- say who it is as soon as the call starts
- say why they are calling
- end the call immediately if some asks or indicates they want it to end
Researchers
Researchers can call or fax numbers on the Do Not Call Register for opinion polling and/or research calls but must follow the rules in the relevant Industry Standard.
If a call or fax is selling something, it is treated as telemarketing.
You can find out more on the Do Not Call website.
If we see serious or ongoing compliance issues, we may investigate. Find out about recent actions we’ve taken.
