BI-502 - Kiis FM

In June 2019, the Australian Communications and Media Authority (the ACMA) commenced an investigation under the Broadcasting Services Act 1992 (the BSA) into the alleged broadcast of an election advertisement for the Liberal Party of Australia.

The advertisement was allegedly broadcast on Kiis FM by Commonwealth Broadcasting Corporation Pty Ltd on 18 May 2019 at approximately 2.35 pm.

The election blackout period for the 2019 Australian Federal Election commenced at the end of Wednesday 15 May 2019 and concluded at the close of the poll on 18 May 2019.

The ACMA has investigated the licensee’s compliance with the licence condition in paragraph 7(1)(j) of Schedule 2 to the BSA, which requires compliance with subclause 3A(2) [broadcast of election advertisement] of Schedule 2 to the BSA (extracts of relevant provisions are at Attachment A).
