The applicant requested documents:
- between ACMA and Telstra for the period 1 July 2024 to 18 July 2024 regarding ACMA issuing the company with a penalty of $1.5m for scam rule breaches;
- between ACMA and Telstra for the period 20 November 2023 to 7 December 2023 regarding ACMA issuing the company with a penalty of $3m for wrongly charging customers;
- between ACMA and Optus for the period 19 February 2024 to 7 March 2024 regarding ACMA issuing the company with a penalty of $1.5m for public safety failures;
- between ACMA and Southern Phone Company for the period 29 April 2024 to 23 May 2024 regarding ACMA issuing the company with a penalty of $244K for inadequate handling of customer complaints; and
- documents relating to how the ACMA reached the above mentioned penalty amounts.
76 documents were identified as falling in scope of this request. Of these, two documents were released in full. Some documents/parts of documents are subject to redactions under s 22 of the FOI Act due to exempt information under s 37 (law enforcement and safety), s 45 (material obtained in confidence), s 47C (information about deliberative processes), 47E (operations of an agency), s 47F (personal information) and s 47G (business information) of the FOI Act. 13 documents have been released in part, and are subject to redactions. 61 documents were fully exempt from release.
Three of documents released in part are currently subject to third party review rights and have not yet been released.
The documents have had additional redactions applied prior to publication under section 11C of the FOI Act to remove personal information.
