WIN Television Queensland breaches captioning rules

The ACMA has found that WIN Television Qld Pty Ltd failed to comply with the captioning rules in the broadcast of two drama programs in late 2024.

Captioning provided for the programs, A Remarkable Place to Die and Chicago Med, broadcast on 24 November 2024 and 2 December 2024 respectively, did not meet the accuracy and comprehensibility factors in the Captioning Standard.

The investigation was based on a complaint that captioning provided for the programs had phrases and sentences missing, resulting in viewers missing what was being said.

The licensee explained that an incorrect setting in the playout system caused captioning to drop out during the broadcast of the programs. The licensee also explained that it had conducted a comprehensive review of all settings in the playout system to prevent a recurrence of the issue.

The ACMA noted that the licensee took remedial action immediately upon the captioning issue being brought to its attention. The ACMA also noted that the licensee had not breached the captioning standard in the previous five years. 

On that basis, the ACMA has decided to not take any enforcement action in this instance and will continue to monitor the licensee’s compliance with the captioning rules.
