The ACMA

FOI disclosure log

From 1 May 2011 the ACMA is required, under section 11C of the Freedom of Information Act 1982 (FOI Act), to publish on its website information which has been released in response to an FOI access request made to the ACMA after that date. This requirement does not apply to the following information:

  • personal information about any person if publication of that information would be unreasonable;
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be unreasonable;
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be unreasonable; and
  • any information, if it is not reasonably practicable to publish the information because of the extent of modifications to a document (or documents) that would need to be made to delete the information listed in the above dot points.

In accordance with the Guidelines issued by the Office of the Australian Information Commissioner (accessible at www.oaic.gov.au) the ACMA will publish this information in the form of a Disclosure Log. The information described in the table below has been released by the ACMA under the FOI Act and is available for public access.

A link is provided if the information can be downloaded from this website. The ACMA will make available the documents for downloading for a minimum period of 12 months from the time the documents are listed on the Disclosure Log.

If the information is not available on this website, it may be obtained by contacting us by email at foi@acma.gov.au. A charge may be imposed to reimburse the ACMA for the cost incurred in copying or reproducing the information or sending it to you. You will be notified if any charge is payable and be required to pay the charge before the information is provided.

The FOI request sought all information relating a complaint made to the ACMA which has resulted in an investigation of Charles Darwin University (8TFM).

Doc 1 is a letter to the licensee of 104.1 Territory FM advising them that the ACMA has decided to investigate a complaint about broadcasting advertisements.

Docs 2 and 3 are correspondence between ACMA and the complainant.  

The complainant's name, signature and email address have been deleted from the documents on the basis of section 47F(1) and paragraph 47E(d) of the FOI Act.

A Cc email address has also been deleted under section 22 of the FOI Act on the basis that it is irrelevant.

The FOI request sought access to documents that disclosed representations to Agency/Departmental considerations by carriers, service providers or organisations representing carriers and service providers (such as Communications Alliance) that relate to the justification of different rates for calls to 13/1300 and 1800 numbers from mobiles as opposed to those made by landline calls. The request was confined to documents created after 1 September 2010.

Summary of FOI request received by the ACMA

The FOI request sought access to documents used by the Content Classification Section of the ACMA (within the last two years) when making a determination on whether a television station has incorrectly classified a broadcast program (where those documents are not already in the public domain). The request specifically included material used in training staff at the ACMA.

Description of information released under this disclosure log (and whether released in full or part)

Five documents were released to the applicant. Three were released in full, and two were partially released, subject to the redaction of information in relation to which the ACMA is exempt from the operation of the FOI Act, under subsection 7(2) of that Act and Part II of Schedule 2 to the Act.

These documents are 'exempt documents' within the meaning of the FOI Act. The documents contain detailed information which is likely to facilitate access to offensive internet content which is exempt under the FOI Act.

The ACMA redacted the exempt material from the documents under section 22 of the FOI Act and the rest of the documents were released.
