Section 19 of the Broadcasting Services Act 1992 (the Act) allows the ACMA to clarify the criteria of the categories of broadcasting services specified in sections 14 to 18 of the Act.
The ABA (ACMA's predecessor) made two s.19 clarifications of the criteria for open narrowcasting services at s.18 of the Act:
- On 20 December 2001, the former ABA made the Broadcasting Services Clarification Notice 2001. This clarification notice was gazetted on 9 January 2002.
- On 22 August 2002, the former ABA made the Broadcasting Services Clarification Notice 2002. This clarification norice was gazetted on 28 August 2002.
The clarification notices apply to non-subscription AM and FM radio services operating in the broadcasting services bands.
